On Thursday’s Daily Show, Trevor Noah tackled the debate over Merrick Garland, President Obama’s pick to replace Justice Scalia on the Supreme Court. Before Obama had even nominated Garland, Mitch McConnell and the rest of the Republican-led Congress announced that they would not confirm any of Obama’s choices. They are sticking by that claim, despite how “totes adorbs” Noah says Garland is. The nominated judge even cried during his nomination acceptance speech, and “next to him even sweet Ruth Bader Ginsburg seems like an asshole.”

And Republicans actually agree that Garland is great. Noah shows a number of clips of even McConnell saying that Garland would make a good justice. “Everyone likes Merrick Garland. He’s like the Paul Rudd of federal judges,” says Trevor, before asking, “Why won’t the Republicans even consider him?” The short answer is: Obama.

The Republican Congress is invoking the “Biden rule,” (not a real rule) that follows Biden’s 1992 suggestion that a new justice should not be confirmed in a president’s last term. McConnell said on the Senate floor, “The decision the Senate announced weeks ago remains about a principle and not a person.” Trevor responds, “Mitch McConnell seems like a bit of a dick. Well, just in principle, not as a person.”

Noah asks Republicans to think about what they are doing. The next president could be Hillary Clinton, who may choose a more liberal justice, or President Trump, who might choose Judge Judy, “just because he’s heard of her.” Watch the clip to see Jordan Klepper give McConnell some advice in the Senate.
